UK law to delay our exit

The government is seeking to delay our exit until October 31 by a negative resolution Statutory Instrument. This is a law which they can make without needing Parliamentary approval first, subject only to a vote in Parliament after the event if Parliament insists on one. I have put my name to the list of those wanting this to be debated and voted on.

Appalling that the Government can do this at all. Any law should be subject to a Parliamentary debate and vote. NO EXCEPTIONS. This country is in danger of becoming a banana republic.

I understand there is a move to get the Party rules changed so May can be resubjected to a confidence vote and that there should be 4 names not 2 on the ballot paper that goes to the membership for the next leader.

I understand a petition to achieve this requires 10,000 signatures. I am a card carrying member of the Party so if you require my signature on either of these petitions, don’t hesitate to ask. I’ll be happy to sign.

The woman has to go – and soon.

Looked on Conservative home but can’t find a link. Can anyone give me one please?

Found one on change.org which I have signed but I’m guessing that’s not it as not many signatures.

May claimed parliament will have a say then guess what?

Lord Panick included govt amendments to Cooper/Letwin treachery that were voted, down in parliament. Who would have thought. Almost as if cabinet working through backbenchers!

Never vote for Mays servitude plan.

This was quietly slipped into the European Union (Withdrawal) Act 2019.

Originally paragraph 14 in Schedule 7 of the European Union (Withdrawal) Act 2018 read, on page 68 here:

      https://www.legislation.gov.uk/ukpga/2018/16/pdfs/ukpga_20180016_en.pdf

“Power to amend the definition of “exit day””

“14 A statutory instrument containing regulations under section 20(4) may not
be made unless a draft of the instrument has been laid before, and approved
by a resolution of, each House of Parliament.”

      Now it reads:

      https://www.legislation.gov.uk/ukpga/2018/16/schedule/7/part/2/crossheading/power-to-amend-the-definition-of-exit-day

“Power to amend the definition of “exit day””

“14 A statutory instrument containing regulations under section 20(4) [F1 is subject to annulment in pursuance of a resolution of either] House of Parliament.”

With the note: “F1 Words in Sch. 7 para. 14 substituted (8.4.2019) by European Union (Withdrawal) Act 2019 (c. 16), ss. 2, 3(2)”

It seems as though this is I predicted and this is a money making scheme with so many convolutions as to add to the 99 billion bill of Brexit

I get the impression they probably realize it is unlikely they will get their surrender doc through parliament; if only because a growing number of politicians are starting to, quite rightly, get nervous about the fallout if they try and force us to remain.

So May is assisting them get their ‘pound of flesh’ with these constant delays.

Surely other MPs, possibly with yourself, have discussed how to remove Mrs May? I think most of the country would welcome success in that regard, the sooner the better. What options are available?

The extension to Art50 changes my rights and obligations. Therefore, as I understand it, according to the Miller case, Parliament must vote first.

    1. GilesB
      April 13, 2019

Exactly so. If primary legislation needed to invoke or revoke Art 50, primary legislation is also needed to ask for an extension of Art 50, or to accept an offer of extending Art 50.

The provision in the EU Withdrawal Act to amend exit day by statutory instrument was to bring domestic law in line with the EU position AFTER the EU position had changed. It is not a power to vary the relationship with the EU and the rights of EU citizens

Indeed it should clearly be debated but most MPs are off on holiday instead! There is a huge cost involved in the delay after all. Can the traitors in the government be stopped from doing this without any debate in some way? How many signatures are needed on the objection list?

May’s “Conservatives” now as unpopular as they were under ‘no change no chance’ John (ERM fiasco) Major (still no apology from the pathetic man). He lost in spades Labour (TonyBlair) 418 seats – Conservatives John Major just 165 seats.

We need to be rid of May and Hammond now before we end up with Corbyn.

    1. Lifelogic
      April 12, 2019

Perhaps this time they will listen to no “change no chance”. This time there is an excellent chance of winning. Surely with sound pro Brexit Conservative leader they would win.

But will this new leader have been put in a £39 billion straightjacket “Brexit means sweet FA to the dishonest traitor Theresa May”.

Brexit party launched today. True conservative values. Donate or help in any way. JRMs sister now standing for them.

If Traitor May goes who will replace her? Remainer Hunt, Javid or sell outs Raab, Johnson and Davis? Who would trust the Tory party manifesto?

Good to see Ken Clarke panicky over May being rumbled to get sacked. He cannot disguise his true thoughts and treachery.

The brexit party is a ruse by the Conservatives, to try to split the UKIP vote. It is being talked up by even remainer journalists on the BBC and SKY paper reviews….proof positive,if one were needed, that it is NOT a genuine leave party…just a tool to enable mainstream parties to hold onto power. It will, however, give Labour more chance than Conservatives, as the conservative brand is completely trashed with May. Even the remain newspapers are promoting the Farage new party. I have been a Conservative for over 30 years, being an activist and a local councillor. I have mow resigned and joined UKIP. We at least know they are the true party for the LEAVE vote.

The government is actually not seeking to delay our exit but to prevent it. The underhand scheming that has gone throughout this charade is disgraceful. Let us hope that the legal challenge already in process proves beneficial and shows we actually left the EU on 29th March this year without an international legal treaty. Your party and our democracy are being sacrificed by Mrs May at the altar of the EU.

What’s the point of further useless debates if Parliament is unable to do anything.

Please John, now use your energy instead in finding a way to get rid of this useless can’t believe a word she says Eu lapdog Prime Minister.

Doesn’t the Withdrawal Act state a resolution must be passed by both Houses?

Is the government breaking the law here? That is, if they don’t follow the Withdrawal Act, it might be held the last voted-on Exit Day must be honoured?

I recall that when the PM’s pro-Remain machinations started to manifest themselves, there were quiet mutterings about instigating praemunire proceedings against her and her team – perhaps these mutterings should become louder.

From now until forever, when British officials voice criticisms of democratic failings or corrupt elections in other countries, the subjects of their criticism will now have been handed the perfect pot-and-kettle riposte:

“Well, so what if Mr Strongman rigged the elections in his favour? You’re fine ones to talk – the largest vote for anything ever in the history of your country and your ruling elites cheerfully stole that, so you had better just shut up about our elections!”

PS to my comment above on Boris and Amber. Also, if I hear any more meaningless slogans from MPs such as One Nation Tory, with all the spiel that goes with it, I will just about expire. Give me Nigel Farage any day. He would get the job done. We would have left by now with him.

Please could you explain to us all who exactly is behind the Withdrawal Agreement.

Who set the parameters, where was it written, and was it a German production as the Bruges Group article stated?

There is a great deal of circumstantial evidence to suggest where the WA originated, but your opinion, or your confirmed knowledge on the matter, would be of great benefit to everyone.

    Thank you.

John, I am not sure why you want this. Mrs May has already signed a Treaty Amendment in Brussels Which will be binding in International law. So she is now regularising U.K. law to match what she has committed the U.K. to in International law.

So what is there to debate and vote on?

You have done the right thing. Interesting to see who in your party vote against, apart from Clarke who I would allow because his position has been honest all along. Hope the DUP are also with you. The PM the conservative party cannot get rid off exceeds the guile of Machiavelli. You will have to go through the humiliation of the local and european elections. Perhaps you can prise her from office on the results of these. My parish council is fielding 9 UKIP and 1 Tory for election plus others of indeterminant loyalty. I cannot vote in this but I can in EU election. I just await the naming of the Brexit Party candidate. I expect her to take control of the party conference in September. What power do you have in control of the agenda and speakers. Any placemen can expect a verbal drubbing from the rank and file. However by then I expect you to have a new PM, and Cabinet that does not perpetuate the career of Sir Godber Evans. Portehouse College awaits his controlling touch. I wonder what Skullion will make of him.

Please can we have further updates regarding this vital question. If Parliament has not varied the (already varied) leave date under Article 50, before going off on holiday, then there must be a constitutional argument that we left the EU on 12th April?

Has everybody noticed the increased cost of EU membership for the UK? It is already high at £14bn, rising to £15bn next year, and £16bn the year after. We are paying heavily for defeat at the hands of the Remoaners.
