I reproduce below the Lord Chancellor’s letter to MPs setting out his new proposals, as I think they are good.
                    A SMARTER APPROACH TO SENTENCING
I am writing to inform you that the Government has laid before Parliament a White Paper entitled âA Smarter Approach to Sentencingâ.
This paper sets out the Governmentâs proposals to deliver on manifesto commitments to crack down on crime and protect the public by ensuring dangerous criminals are kept in prison for longer.
Our current sentencing and release framework is failing to give victims and the wider public the confidence they should have in our criminal justice system. Too often the time offenders spend in prison does not match the severity of the crime, with some of the most serious criminals being released after serving only half their sentence.
At the heart of this paper are reforms to the sentencing and release framework in England and Wales, which will see certain sexual and violent offenders serve longer jail time, while new measures aim to tackle the underlying causes of criminal behaviour and improve the rehabilitation and supervision of offenders in the community.
Keeping dangerous criminals in prison for longer
Our white paper sets out plans to make whole life orders the starting point for child killers, as well as allowing judges the discretion to hand out this maximum punishment to 18-20-year olds in exceptional cases (where, currently, only those aged 21 and over may receive a whole life order). We are ending the halfway release of offenders sentenced to between four and seven years in prison for serious crimes such as rape, manslaughter and GBH with intent. Instead they will have to spend two-thirds of their time behind bars, like those serving determinate sentences of more than seven years already do following the legislation we brought in earlier this year. We will also introduce a new power to prevent automatic release for offenders who pose a terrorist threat or are a danger to the public and are serving standard determinate sentences. We will also legislate to increase the time discretionary life sentence prisoners and certain sex offenders must serve in prison before they can be considered for release by the Parole Board.
Tougher community sentences which tackle the underlying causes of crime
The white paper includes plans to make community sentences stricter, better monitored and more targeted at cutting reoffending by tackling issues associated with criminality. More vulnerable offenders who do not pose a risk to public safety will be diverted into treatment programmes to recover from these serious issues, such as mental health, alcohol or drug addiction programmes. This will help them lead crime free lives, ultimately helping drive down reoffending rates alongside strengthened supervision to ensure compliance.
Community sentences will be made tougher by doubling the amount of time offenders can be subject to curfew restrictions to two years for more serious criminals. Courts and probation staff will be given more flexibility to use those curfews to support rehabilitation. For example, by having lesser restrictions Monday to Friday to keep offenders in work, but stricter curfews of up to 20 hours a day on weekends. The robust measures aim to provide strong but rehabilitative punishment in the community.
GPS tagging for burglars
Meanwhile, for the first time, GPS electronic location monitoring will be used to track burglars, robbers and thieves when they are released from prison. Reoffending rates among these offenders is amongst the highest across all offence types, with individuals convicted of theft who reoffend doing so on average five times over their lifetime. The technology will allow probation to monitor an offenderâs whereabouts and where appropriate share this data with the police to support them investigating and prosecuting these crimes.
The move builds on Governmentâs plans to make greater use of electronic tags to cut crime, following the rollout of GPS monitoring over the last twelve months and plans to begin using so-called âsobriety tagsâ to tackle alcohol-related offending.
Reducing Re-offending
There is more that we, across Government, need to do to address reoffending. Reoffending weakens public confidence in the criminal justice systemâs ability to deal with offenders. It also has a significant financial cost, not only to the criminal justice system, but to wider society. This paper introduces cross-government work underway to develop ambitious plans to reduce reoffending, focusing on employment, accommodation, and substance misuse. An important first step is supporting ex-offenders striving to turn their lives around through work by reducing the time in which they are required to disclose certain convictions for non-sensitive roles.
Alongside this, work is underway to boost education in prisons. Ministers will deliver on the manifesto commitment to develop a Prisoner Education Service, focused on work-based training and skills. It will build on recent reforms that have already enabled Governors to commission education services that meets the needs of their prison populations and local economies. The ability to improve prisonersâ functional, vocational and life-skills is key to support wider rehabilitation and reduce reoffending on release.
Next steps
The Government will bring forward legislation next year to deliver on the proposals set out in this paper.

Stephen Priest, I have written to my (Tory) MP. He could not take on board that the covid19 death toll is below that of influenza and pneumonia. He trotted out the party line as though we back in March, but refused to give any evidence despite being asked.

These thoughts on crime and criminals are no more than that, even when the legal framework changes to accommodate this new approach. The greatest deterent to commiting crime is getting caught. The police force are the supposed catchers, but a more limp wristed collection of knee takers it would be hard to imagine.
The same bunch of social engineers that are currently telling those in Parliament how to think have already knobbled our police force. A process which started way back in the sixties. I relate a true story.
Many years past my neighbour was a retired Assistant Chief Constable who over dinner one evening recalled his experience of passing through the police staff college at Bramshill. The lecturers were almost 100% social scientists, hardly a thief taker amongs them. You went along with the thinking or failed the course. The product of this thinking is now running our police force to no great effect as far as crime is concerned. Until there is a seed change in the upper reaches of policing the current situation will continue much to the chagrin of all the law changers in Parliament. You do not alter the current situation by changing the rules, you do it by catching criminals.
The thinking in present police attitudes to crime must have its roots in the Home Office. That is where the tsunami must first occur, moving via Bramshill to senior policemen. Given leadership the police on the street would I am sure relish getting on with the job unencumbered with the PC crap that governs them.

For those who do not like what I say I would point out that detection rates leading to a prosecution have fallen from 9.1% to 7.8% in the UK. What greater incentive could a criminal have than a 92.2% chance of success.
One element I have omitted in the fight against crime are the judiciary. We need them to be 100% on side and free from social engineering.

Yet another reason for not sending criminals to prison is that our prisons are full. 11% of those in prison are not UK citizens. Why don’t we return them to prison in their country of origin, so freeing up space for our own criminals who ought to be in prison. We also save money in not housing them.
Then there are those who after the granting of citizenship take to crime. Should we not consider revoking their citizenship and expelling them from the UK. We did it for immature Isis camp followers, why not for other categories of criminality.

Yes there is merit in government taking over the business providing the product is administered under proper medical supervision with clean needles and a programme of rehab. Problem is, drug addiction is much more widespread than most of us realise, particularly as many see it as a recreational habit rather than addiction.
I suspect ones genetic make up has something to do with it. I was addicted to tobacco many years ago but forced myself off it. Alchohol I can take or leave without feeling any compulsion to use it out of need, unlike my attitude to tobacco some fifty years ago. I suspect others have the same mixed response to the current drugs of the day. Any response by government needs to be carefully thought through with with medical expertise.
Yet another response would be to buy the crop at farm gate prices and encourage the peasant farmers to grow apricots. Afgahnistan could be our next trade deal? I realise it is not as simple as that, destroying the home market by take over should be the first step.

This is why we need politicians with skills far more associated with scientists: the ability to investigate and analyse problems effectively, the capacity for problem solving leading to effective solutions through changes in the law. What we have are politicians, some of whom are patriots who find themselves constrained from speaking out by laws created by parliament which they should wish to reform.

Oh please. Police patrolling is not considered worthwhile. Look at the huge number of departments working 8-4 Mon-Friday. Met has more officers looking at hate crime (900) from offices than some small forces have in total number!
Avon and Somerset police watched and allowed a statue to be torn down by a mob rolled half a mile on a road then dumped in the river. The chief constable on TV stated he supported his officers!
Drug offenses not looked at, down graded to be pointless for the police to take action. Offenders go on courses or activities! JRs Fake Tory govt.

Always looks good on paper. It will get a few headlines which is its main objective but the resources to make it work effectively will not be provided. Does anyone truly think community gadabouts are punishment or that there will be anything other than a âlick of paintâ provided for the mentally ill etc. If so looking at past history they are deluded.
We allegedly already have a strikes policy with knife crime, the police do their utmost to let people off with the lightest caution possible to reduce their work and not that long ago, a prisons minister was telling people to let out or reduce the so called less dangerous because the prisons were over capacity.

As others have said, it is the certainty of being caught, not whether the time served is half or two thirds of the sentence. Harsh sentences are no compensation for incompetent policing.
And any government blurb which claims a “smarter” approach, or announces a “crack down” is likely to be garbage, on past experience. “Crack down” on immigration? “Smart” motorways? “Smart meters”? “Smart” sentencing? Ugghh!

Since crime is credibly estimated to cost seven percent of GDP – and contingent costs even more – this is not before time.
This absolutely dwarfs expenditure on European Union membership, overseas aid, etc.
Furthermore, since our crime rate is about twice that of the Mainland’s pro-rata, if it could only be reduced to the European average then that would represent huge savings.
However, that would mean a radical restructuring of UK society in a way which would not suit the wealthy, ruling, elite, British Establishment, which John’s party epitomise, so we’re probably stuck with it.
But carry on wailing about sing-songs in the Albert Hall and such matters instead.

The Home Office estimated the cost of crime in England and Wales at ÂŁ59 billion. Why they left Scotland and NI out I know not. It’s level relative to the EU or anywhere else is irrelevant, but as you point out, it is mind boggling high. I wonder whether the HO include the taxes lost on the profit from crime in their figures.
Your call for the radical restructuring of UK society implies that the groups within the establishment you highlight are the beneficiaries of crime. A stretch by any imagination. I cannot see crime halting were the establishment you describe removed completely. Nevertheless I too would like to see an equality of opportunity established throughout UK society. I submit that it would create even greater wealth from which the disadvantaged in our society could be properly looked after.
The night at the proms was one of lifes fringe activities, in the hands of and disaproved of by the BBC. A BBC that could not epitomise that metro elite establishment more strongly than any other conceived part of it. They made their play and society rejected it. Society was not distracted by Covid19 to sufficient degree as to ignore what the BBC were up to.

Martin, It is actually quite difficult to compare the crime rate in different countries due to variations in what the crime is, and in the ways of recording it. Your sweeping claim that UK crime is about double that in the rest of Europe is therefore bogus and simplistic.
According to the UN an assessment (2016) of homicides per year per 100,000 inhabitants puts the UK at 174th out of 220 globally. For general crime, Numbeo ranks the UK as 8th out of 39 in their European Crime Index; the worst being France, Ukraine and Sweden. The UN records (2017) rates for robbery per 100,000 as: France 154; Germany 47; Italy 51; Spain 132; Sweden 87; UK (E&W) 131. None to boast about, but certainly not your false “twice”.

Ever more draconian sentences do not work.
The US has the death penalty, but their murder rate is five or six times the European Union’s pro-rata, which does not have it.
It is necessary to look at what leads people to crime, and Labour under Blair were successful in that regard, achieving striking reductions.
It’s notable that this country has de facto legalised what are crimes in others too. For instance, a good few public figures in France are in prison for “traffic d’influence” – I need not translate – whereas in the UK it would appear to be the usual, legal method for raising party funds.

Nothing harsh is proposed, Martin: merely that existing law is ENFORCED simply and efficiently.
Progress and money are wasted locking people up. The ZigZag uniform devalues offender intent by wrongdoers realising that they need to behave well to gain cooperation and trust of fellow citizens each day.
Law enforcement is naturally firm and fair. You don’t carelessly jump off a 12-storey building: because the Law of Gravity would reject your appeal for broken body remission without even a hearing.
Where risks are conspicuous, such as a black and yellow ZigZag outfit identifies, both the offender and the innocent victim can avoid what would otherwise result in harm to both.

Why sentence a criminal to 7 years if that really means 3.5? Why not just sentence them to 3.5. I could understand letting a criminal who has demonstrated good behaviours out 6 months early on a long sentence but not after half to two thirds of their term. That just means that tariffs sound tough but are not.
If we are letting criminals out early because we don’t have enough space then build more prisons and deport foreign criminals and pay for their incarceration in foreign jails.
We do not need to worry about the conditions faced by those serving whole life terms as they should not get out and do not need rehabilitation. They can suffer horribly in prison, I am partial to dungeon style incarceration for these types.

I think crime committed by minors needs to be addressed. Someone aged 10 knows the difference between right and wrong. We should certainly set the legal barrier at 13. No minor aged 13 or over, and who is found guilty, should have the luxury of having their name withheld from the media. We also need to review lenient sentences being handed down to some minors, most especially where it is a repeat offence. Sentences which are far too lenient are an affront to the victims.

During lockdown I have been cycling around the Epsom âclusterâ a group of mental hospitals in close proximity that even had their private rail system at one time.
They are all closed now. New housing developments are now on the site with aspects, like an old water tower, left as an attractive feature and a nod to past history.
This was purely to save money. âCare in the communityâ was the phrase used to mask this. Changes in care for the mentally ill could still have taken place in those institutions, which were very well built and in attractive green areas. The patients would be better cared for and there would not be a danger to others from those who could not cope outside on their own.

One of the great things about the American system is the lengthy jail sentences for criminals and the worst recidivists in particular. I donât know how they finance it- whether it is at state or federal level. This country should try to follow their example though.
However, I have always thought that cost-cutting was one reason for the light sentencing policies we find in the U.K. A cynical interpretation of the letter, based on previous experience, is that it will be all fine words to mollify voters but nothing fundamentally will change.

Well for most crimes we need real deterents and they need to know they are likely to be caught. I have over my lifetime reported many crimes car damage, theft, burglary, fraud, assualt, vandalism. In none of these have the police ever done much at all to try to catch anyone. Even though in some cases this was quite easy.
They did however once prosecute me for an MOT that has run out three days earlier (as I had not noticed) plus I have had many parking fines, bus lane fines, hatch junction fines. Many as they have clearly designed the system to trap people. It is all a question of priorities. We can all see where the states priorities are. Do nothing unless it raises money.
I see that the appalling Mayor of London (who is set to be re-elected – no serious oposition) have made bus lanes 24 hour as part of his road blocking and fund raising policy.

One of the main problems at the moment seems to be the reluctance to prosecute some crimes, the police seem to have almost given up on so called low level crime because the punishment if any does not fit the crime, so what is the point.
I would suggest that if the smaller so called low level crime is not nipped in the bud, then many offenders are encouraged (by lack of prosecution) to continue with a life of crime.
Just issuing crime numbers to the victims for the record, is not very helpful unless you need make a claim on an insurance policy.

The primary role of any government is to protect its citizens from harm. Prison works by protecting the public from exposure to known criminals, when you are in jail you cannot burgle, vandalise assault or intimidate the law abiding public. Possible reform of prisoners is a luxury, “it would be nice if” adjunct but is not essential. Light sentencing, suspended sentences, community service etc are no deterrence and do not protect the public.
As in the USA sentences should be consecutive for multiple crimes and Fraudsters should have a sentence based on the time required to pay back their theft at the mimimum wage for the money not recovered. It should not be possible for someone not to be imprisoned because it is ” too difficult” because have numbers of dependents who need looking after.

There is community support work that fraudsters and other motherly criminals could and should do at home and in their local area, I see many volunteer Mums with their prams and a litter sac attached to it picking up litter in parks, their little darlings could help their mother to make amends. This post is about justice, so not exactly off topic. Boris is effectively closing our businesses down again. I have just spoken to somebody who was on the govt mandated maximum of ÂŁ2,500 per month during furlough.
In the interest of justice, the PM, all MPs and Civil Servants should refund their salaries for this year to date, retaining ÂŁ2,500 pm (max) and continue at that rate until the country is free to earn its own living.
To add insult to injury, I understand that many people on benefits received more than ÂŁ2,500 per month throughout this political crisis, tax free.

I think Vallance must have become a stereotypical politician, he manages to say something that the data does not say (I refrain from a VW joke despite the temptation).
The data at https://coronavirus.data.gov.uk/ can be summarised as
(i) Positive tests by specimen date showing a rapid increase from 27th August to 6th September then plateauing
(ii) (Smoothed) positive tests by report date as a percentage of pillar1&2 tests by report show a growth from about 0.5% to 1.5% over a similar period. It is appears to be slowing thereafter, perhaps taking 10 to 14 days to reach 2% (i.e. not doubling in a week, but there is insufficient data). The unsmoothed data of this percentage has a worrying step at about 6th September, this could be real but looks odd.
All of the above is non-informative (apart from what it indicates about Vallance’s presentation) since
1. It does not separate Pillar 1 and Pillar 2.
2. It does not allow for a changing false positive rate (the labs have been having problems and staff changes, we do not here reports of external quality assessments),
3. It does not allow for a changing population presenting for testing,
4. It does not include number of specimens to allow a percentage of positive tests by specimen date (which presumably is what we actually want)
Moreover,
there seems to be no causal analysis of the uptick in elderly deaths with Covid, this of course is where the hazard from the risk has most impact. Where / how did these vulnerable people become infected is surely (one of) the most important questions to urgently answer – this is where life saving levers could be identified.

I do not think we should be discussing this now. Now we live in a pathologically tyrannical dictatorship, it is this that MPs need to stand up to. We have a Govt that aims to instil fear into, bully and abuse the general population for living their everyday lives – it is not time to encourage them. Persecution is still persecution however equally it is applied. I used to think it was mainly Hancock and Sunak that needed to go, but clearly the PM needs to be brought down within days and Conservative MPs need to get on with this for the sake of the country.
(On the topic, if we ever live in a free country again We need police freed up and supported to actively police, preventing as well as catching real criminals breaking real laws. We also need to stop the identity counting and proportionality seeking, either someone is s criminal or they are not.)

From the MsM, Prof Gloom and Dr Doom are suggesting the UK will have an infection rate 50% higher by population count than any other Country has yet experienced. All happening by mid October. The figures are from unverified science once more. Its not science if it cant be proved or cant be peer reviewed.
These people have yet to learn ‘Project Fear’ in any disguise will not get people on-board, it just causes kick back and dis-interest.

A step in the right direction.
Prisoners are like school children – when you put them together they have a bad effect on each other. Finding a way to keep them apart for (much) longer periods would prevent this.
Giving them useful work to do in order to earn having their sentences reduced at all (even 1/3 should be subject to doing something useful).
I would start with recycling rubbish. Have them working to sort rubbish into recyclable, land-fill and other sub-categories. All while being under video surveillance and only being able to do it with a robot arm moving items on a conveyor belt that’s behind toughened glass so that they can’t filch anything that might be “useful”.
There will be a non-prisoner overseeing the output – if they try to be silly then the quality control person will see that and it can be established by checking the video who did what and what effect that should have on sentences.
At the moment we have citizens expected to sort items and lots ends up in landfill that shouldn’t be there. This could be a win-win for society.

Of topic, but many here with an interest in the Royal Navy will be relieved at the statement made in the Commons by Defence Secretary Ben Wallace yesterday, concerning the replacement Fleet Solid Support Ships.
âI intend to announce the procurement timetable for these (up to three) warships in due course, after market testing has completedâ.
The key word here is “warships” – at last the government has accepted this definition. This is important because according to government policy, âwarshipsâ must be built inside the United Kingdom.
Also noteworthy are the visits this month to HMNB Clyde (aka Faslane) of two US Navy submarines – USS John Warner, a Virginia class nuclear attack boat and USS Seawolf, one of only three of this class of hunter-killer submarines.
These visits signify acceptance of Faslane by the US navy as a suitable and secure berth for these highly capable nuclear powered submarines and greater interest in Russian naval activity in the area.

Yes – but FORT ROSALIE and FORT AUSTIN entered service in 1978 and 1979. (I visited the lead ship at a Navy Days BEFORE I joined the Navy, and have since completed a full career and a large chunk of retirement.) These two ships are now, according to Wiki, in ‘Extended Readiness’. And orders for their replacements have yet to be placed. This is an appalling example of capability management by the MoD under a Conservative government.

According to the latest output from the Government’s bingo-caller, 30 people can attend a funeral (including the deceased?) but only 15 are allowed at a wedding. So my suggestion to those who want a larger wedding is to identify one of the many people who die with no surviving relatives and hold a funeral for them. You can exchange vows over the coffin and neither Boris nor the virus will be any the wiser.

I heard a Tory backbencher called Graham Brady moan about this on just about every media outlet yesterday. He is chairman of the 1922 Committee – so named because most Tory MPs are still stuck 100 years in the past.
Anyway Mr Brady was moaning about Parliament having a say. But if you listened to him he didnât mean Parliament at all. He meant the Conservative Party.
He was outraged that the Conservative Party didnât have a say in all this.
As a member of the 58% of voters who rejected the Conservative Party at last Decemberâs election, I could not care a jot what the Tory party think. We have no voice at all – ignored by an incompetent authoritarian leader of an incompetent authoritarian party.
This is not my prime minster. It is not my government. I donât care what restrictions these failed clowns announce. I will live my life as I see fit and I really donât care about their dictats. Oh, and I am in the majority and you lot are not.

Sentancing is not the major issue, for it can be readily altered.
Of reported crime, the rate of detection does not exceed 9 percent, yes 9%. This is defined by whether charges are brought, not convictions achieved.
So every criminal goes out with the expectation of only 1 in 11 chances of being prosecuted. No wonder there is so many doing it time and again. Without custody, bail enables multiple offences to be committed in a short time . 5 1/2 million recorded crimes in England last year, how many criminals?

As many have noted there is much injustice going on 24/7 not only in Britain but elsewhere. Technology is used and abused increasingly to commit crimes and online videos and TV dramatically reveal its extremes. Seeing what the emergency services have to deal with on the ground is often just appalling.
Blatant disregard of respect for the police and the recent violent deaths of vulnerable PC officers should be the litmus test of law and order. I believe this test is critical to the future of Britain and we ignore it at our peril. We are on borrowed time.
